General Terms and Conditions (T&Cs)

Scope
(1) These General Terms and Conditions ("T&Cs") apply to the use of the website www.pfadiball.at and all associated mobile applications (together, the "Services"), as well as to the purchase of tickets for events ("Events") held by the Wiener Pfadiball.
(2) By purchasing a ticket or using our Services, you accept these T&Cs as binding. Deviating terms of the customer will not be recognised unless we have expressly agreed to them in writing.
(3) These T&Cs apply exclusively to the website and to tickets sold for the Verein für Freizeitveranstaltung und Kulturförderung's own events.
(4) You confirm that you are of legal age and legally capable of entering into binding agreements. Minors require the consent of a parent or legal guardian.
Conclusion of Contract / Booking
(1) By selecting an event, providing the required information, and clicking the "book with payment obligation" button, you submit a binding offer to purchase tickets.
(2) The booking is only finalised once we accept your order via confirmation email. Prior to that, you will only receive an acknowledgement of receipt, which documents that the booking was received but does not constitute a legally binding contract.
(3) For payments made via real-time payment services (e.g. PayPal), the contract is deemed concluded as soon as payment has been successfully initiated.
(4) The conclusion of the contract and all related communication will take place in German.
Prices and Payment
(1) We reserve the right to correct price information prior to confirming a booking, particularly in the case of obvious errors. You will only be charged the price you agreed to before confirmation.
(2) Payments are made using the payment methods offered on the website. Credit card or bank account details may optionally be saved for future bookings, in accordance with applicable security standards (e.g. PCI DSS).
(3) For payments made via online services, the organiser reserves the right to cancel bookings in the event of suspected fraudulent activity.
Admission and Entry Conditions
(1) The purchase of a ticket does not guarantee a right of admission. We reserve the right to refuse entry, in particular in cases of a ban from the premises, security concerns, or violations of the house rules.
(2) Tickets may not be resold, transferred, or used commercially. Violations entitle the organiser to refuse entry or invalidate the ticket.
(3) By entering the event, guests accept the applicable house rules. Failure to comply may result in exclusion without refund.
(4) A valid official photo ID may be required for admission.
Photo and Video Recordings
(1) Photo and video recordings will be taken during the event by the organiser and persons commissioned by the organiser.
(2) These recordings may be used and published for the purpose of documenting the event as well as for public relations and promotion of the Wiener Pfadiball (e.g. on the website, on social media channels, in printed materials, or in press coverage).
(3) By entering the event, the resulting contractual relationship with guests establishes our legitimate interest in guests potentially being recognisable in such recordings, and that these recordings may be used free of charge, without time or location restrictions, for the purposes stated above.
(4) Should an individual depicted not wish, in a specific instance, to consent to publication, they have the right to object without giving reasons. In this case, we ask that the organiser be notified either on-site or subsequently by email to contact@pfadiball.at.
Withdrawal, Refunds, and Force Majeure
(1) There is no general entitlement to a refund, in particular in cases of non-attendance, late arrival, or exclusion from the event.
(2) In the event of cancellation due to force majeure (e.g. official prohibitions, natural disasters, pandemics), we will refund the ticket price or offer rebooking to an alternative date.
(3) Changes to or reductions in the event programme do not give rise to a right to a refund.
Right of Withdrawal
(1) The purchase of tickets for events with a fixed date is excluded from the right of withdrawal (Section 18(1) of the Austrian Consumer Protection Act, KSchG).
(2) Rights of withdrawal apply only to services that are not tied to a specific date and for which the statutory right of withdrawal is not excluded.
(3) Any applicable right of withdrawal may be exercised within 14 days by way of a clear statement addressed to:

Vouchers, Discounts, and Special Promotions
(1) Vouchers, discounts, or special promotions ("Offers") are valid only for the specified period and subject to their respective conditions.
(2) Offers may not be resold, transferred, altered, or used commercially unless expressly permitted in writing.
Intellectual Property Rights
(1) All content, trademarks, logos, texts, images, software, and other materials on the website and within our Services are protected by copyright.
(2) You are not granted any rights to the intellectual property, other than the use of purchased tickets within their intended scope.
Liability
(1) We are liable only for intent, gross negligence, injury to life, body, or health, or breach of material contractual obligations.
(2) For slight negligence in respect of material contractual obligations, liability is limited to the typical, foreseeable damage.
(3) Liability under product liability law or for expressly given guarantees remains unaffected.
(4) Guests under the influence of alcohol, drugs, or other intoxicating substances may be refused entry. The organiser is not liable for any resulting damage or incidents.
On-Site Safety and Instructions
(1) All guests are required to follow the instructions of event staff and security personnel.
(2) In the event of violations of the house rules, safety regulations, or legal requirements, the organiser may refuse entry or exclude the guest from the event, without any entitlement to a refund.
Conduct of Third Parties / Disruptive Behaviour
(1) Personen, die ohne Genehmigung Aufnahmen, Werbung oder Promotion während der Veranstaltung durchführen, dürfen vom Veranstalter verwiesen werden.
(2) Gäste haben auf die Anweisungen des Veranstalters oder seines Personals in diesem Zusammenhang unverzüglich zu reagieren.
Additional Services / Catering
(1) The organiser assumes no warranty for any food, beverages, or other services offered.
(2) Guests are themselves responsible for any allergies, intolerances, or personal harm resulting from these services.
(3) Complaints must be reported to staff immediately; a refund or liability is only possible within the scope of applicable law.
Items Brought by Guests
(1) Guests may only bring items that pose no risk to the proper running of the event.
(2) Prohibited or dangerous items may be confiscated by event staff.
(3) The organiser assumes no liability for valuables or items brought by guests that are surrendered or confiscated.
Guest Liability and Conduct in the Event of Breach of Obligations
(1) Each guest is liable for any damage they cause to property, facilities, or persons, in particular in cases of vandalism, wilful destruction, theft, or other unlawful acts.
(2) The organiser is entitled to exclude guests who violate the house rules or legal requirements from the event.
(3) In the event of suspected criminal activity, the organiser is entitled to temporarily detain the individual concerned and establish their identity until the arrival of law enforcement.
Indemnification
You indemnify us against all claims, damages, or costs arising from a breach of these T&Cs, including the misuse of tickets or Services.
Amendments to the T&Cs
We reserve the right to amend these T&Cs. New versions apply to all bookings made after they take effect. Continued use of the Services after an amendment to the T&Cs constitutes acceptance.
Third-Party Links
Our website may contain links to external websites. We are not liable for the content, data protection practices, or damages caused by external websites.
Applicable Law and Jurisdiction
(1) Austrian law applies, to the exclusion of its conflict-of-law provisions.
(2) The place of jurisdiction for all disputes is Vienna, unless mandatory consumer protection provisions state otherwise.

Final Provisions
(1) Should individual provisions of these T&Cs be invalid, the validity of the remaining provisions shall remain unaffected.
(2) These T&Cs constitute the entire agreement between the user and the provider and supersede all prior oral or written agreements.
